1. Introduction
These Terms of Use (the Terms) govern your use of the IndCals mobile app and the services it provides (together, the Service). IndCals is a nutrition, fitness and health-tracking app built for users in India. The Service is operated by B2Brand Media Private Limited (we, us, our).
By creating an account, or by continuing to use the Service, you agree to these Terms and to our Privacy Policy and DPDP Notice. If you do not agree with any part of them, please do not use the Service.

2. Who provides the Service
The Service is operated by B2Brand Media Private Limited, a company registered in India with its registered address at Saideep Apartment, Lakshmi Nagar, Amrutdham, Panchavati, Nashik, Maharashtra 422003, India.
We are the data fiduciary for your personal data under the Digital Personal Data Protection Act, 2023 (the DPDP Act): we decide what personal data is collected, why it is collected, and how it is protected.

3. Eligibility
You must be at least 18 years old to use the Service. The Service is not intended for children, and we do not knowingly collect personal data from anyone under 18. If you believe a child has used the Service, contact our Grievance Officer so we can delete the account and its data.
The Service is designed for users in India. Some features may be unavailable, or may work differently, outside India.
4. Your account and phone sign-in
You sign in with your mobile number and a one-time password (OTP) sent by SMS. Your number is your login identifier, so keep it current. If your number changes, update it in the app so you do not lose access to your account.
Keep your account and your OTP private. Do not share your account or let anyone else use it. You are responsible for activity carried out through your account.
Tell us promptly if you think your account has been accessed without your permission. You can write to us at help@indcals.com.
5. What the Service does
The Service helps you log meals, weight and health-related information, and shows you trends, calorie and macro targets, and plain-language guidance based on what you log. Some features use automated analysis of a meal photo or a barcode.
The Service is informational and is meant to support, not replace, the advice of a qualified doctor, dietitian or other health professional. See section 6.
We work to keep the Service available, but we do not promise uninterrupted or error-free operation. Maintenance, network problems and events outside our control can cause downtime.
6. The AI assistant and health guidance
The assistant inside the app and the summaries it produces are generated automatically from the data you have logged. They are informational only. The assistant is not a doctor, clinic, diagnostic service or emergency service, and it does not diagnose, prescribe or direct any treatment.
Automated estimates, including calorie and nutrient estimates from a meal photo, can be inaccurate or incomplete, and guidance built from your data can be out of date or unsuitable for your exact situation. Always check important health decisions with a qualified professional, and treat the assistant output as a prompt to talk to a clinician rather than as a final answer.
Where the app shows a reference range for a blood marker, that range is general information only. Your own lab report and your doctor's interpretation always take priority.
Never use the Service for a medical emergency. In an emergency, call 112 in India or go to the nearest hospital.
7. Subscriptions, payments and refunds
Some parts of the Service are offered as a paid subscription (IndCals Plus). The price, billing cycle and what is included are shown on the paywall before you subscribe.
Subscriptions are billed through the payment method you choose at checkout. Payments are processed by our payment provider or by the app store you download from, and we do not store your full card or bank details.
If a subscription renews automatically, we will tell you before you subscribe. You can cancel at any time through the platform or payment method you used, and you will keep access until the end of the period you have already paid for, unless the law or the store rules say otherwise.
If you paid through the Apple App Store or Google Play, that store handles your payment and its own refund policy applies. Please raise a refund request with the store first, and contact us if you need help understanding the outcome.
If you paid us directly through another payment method, you may request a refund by writing to us at help@indcals.com within 7 days of the charge where the Service did not work as described. Where we approve a refund, we return the amount to the original payment method within a reasonable time.
Nothing in this section limits any right you have under the Consumer Protection Act, 2019 or any other applicable law. If you believe you have been charged in error, contact us at help@indcals.com and we will investigate.
8. Acceptable use
Use the Service only for lawful, personal purposes. Do not attempt to break, probe or bypass the security of the Service, scrape or copy data at scale, send spam, or gain access to another person's account.
Do not upload content that is unlawful, infringing, harmful, misleading or that you do not have the right to share. Do not interfere with the Service or with other users.
Do not use the Service to give medical advice to others or to present its automated output as a diagnosis.
9. Data and content you submit
You keep ownership of the personal data and content you submit, such as your profile, meals, weight entries and health information. You grant B2Brand Media Private Limited a limited licence to store, process, display and back up that content only to run and improve the Service for you, as described in the Privacy Policy and DPDP Notice.
You are responsible for the accuracy of what you enter, including health information. Enter it carefully and keep it current, because the guidance the app gives depends on it.
10. Intellectual property
The app, its software, design, brand, text and graphics are owned by B2Brand Media Private Limited or its licensors and are protected by Indian and international intellectual-property law.
You get a personal, non-exclusive, non-transferable and revocable right to use the app for your own non-commercial use. That right ends when your account or access ends.
You may not copy, modify, distribute, sell, sub-licence or reverse-engineer the app except as Indian law expressly allows.
11. Privacy and data protection
Your privacy is governed by the Privacy Policy and DPDP Notice, which explains the personal data we collect, why we collect it, how long we keep it, and the rights you have. The Privacy Policy is part of these Terms.
We process your personal data in line with the DPDP Act. Where the law requires consent, we ask for it clearly and separately, and you can withdraw it at any time. Your health data is handled under the separate health-data consent described in the Privacy Policy.
12. Third-party services
The Service may link to, or rely on, third-party services such as payment providers, app stores, and the health platforms you choose to connect. Those services have their own terms and privacy policies, which apply when you use them.
We are not responsible for third-party services. We share only the data needed for the feature you asked for, as described in the Privacy Policy.
13. Disclaimers
The Service is provided on an as-is and as-available basis, with all faults, to the fullest extent permitted by law.
Nothing in the Service is medical, nutritional, legal or financial advice tailored to you, and it does not replace advice from a qualified professional. You use the Service and act on its output at your own discretion.
14. Limitation of liability
To the extent permitted by law, B2Brand Media Private Limited is not liable for indirect, incidental, special or consequential loss, or for loss of data, profits or goodwill, arising from your use of, or inability to use, the Service.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including your rights under the Consumer Protection Act, 2019.
15. Suspension and termination
You can stop using the Service at any time. You can delete individual entries in the app, and you can delete your account and its data from Settings > Delete account. Deleting your account is permanent and cannot be undone.
We may suspend or close an account that breaches these Terms or the law, or that harms the Service or other users. Where we do, we will try to tell you why and give you a chance to respond, unless the law or safety requires otherwise.
On account deletion, we erase your personal data as described in the Privacy Policy, subject to any retention the law requires.
16. Changes to these Terms
We may update these Terms as the Service or the law changes. When we publish a new version, we will show it, update the date at the top of the page, and where required ask you to accept it before it applies to you.
If you continue to use the Service after a new version is published and accepted, the updated Terms apply.
17. Governing law and jurisdiction
These Terms are governed by the laws of India. Subject to any consumer-protection law that gives you the right to a local forum, the courts at Nashik, Maharashtra, India have exclusive jurisdiction over disputes arising out of or in connection with these Terms or the Service.
Before starting formal proceedings, please raise the issue with our Grievance Officer so we have a chance to resolve it.

We will acknowledge your complaint and aim to resolve it within the time required by applicable law, including the DPDP Act and its rules. If you are not satisfied with our response, you may complain to the Data Protection Board of India as described in the Privacy Policy and DPDP Notice.
